Welcome to HOGA - House of Gentle Arts ("HOGA", "we", "us", or "our"). These Terms of Service ("Terms") govern your use of our gym facilities, classes, and services located at Giessereistrasse 18, 8005 Zürich, Switzerland.

By participating in our programs or using our facilities, you agree to be bound by these Terms.

1. Membership and Registration

1.1 Membership Types

We offer various membership types including but not limited to:

  • Adult memberships (Brazilian Jiu Jitsu and Grappling)
  • Kids programs (ages 3-15)
  • Student memberships
  • Day passes
  • Trial memberships

1.2 Registration Requirements

  • All members must complete a registration form and waiver
  • Members under 18 must have parental consent
  • Medical clearance may be required for certain conditions
  • All information provided must be accurate and current

1.3 Membership Fees

  • Membership fees are due in advance according to your chosen plan
  • Fees are non-refundable except as specified in these Terms
  • We reserve the right to modify membership fees with 30 days' notice

2. Facility Use and Safety

2.1 Code of Conduct

All members and visitors must:

  • Follow all gym rules and instructor guidance
  • Respect other members, staff, and facilities
  • Maintain proper hygiene standards
  • Wear appropriate training attire

2.2 Safety Requirements

  • Training is at your own risk
  • Follow all safety protocols and instructions
  • Report injuries immediately to staff
  • Training while under the influence of alcohol or drugs is prohibited

2.3 Prohibited Activities

  • Unsupervised training outside of class hours
  • Use of facilities for purposes other than intended training
  • Photography or recording without explicit permission
  • Bringing guests without prior approval

3. Health and Liability

3.1 Health Requirements

  • Members must be in adequate physical condition to participate
  • Disclose any medical conditions that may affect training
  • Training with contagious illnesses is prohibited
  • Seek medical clearance when returning from injury

3.2 Assumption of Risk

Brazilian Jiu Jitsu and martial arts training involve inherent risks including but not limited to:

  • Physical injury
  • Equipment failure
  • Contact with other participants

By participating, you acknowledge and assume these risks.

3.3 Liability Waiver

To the fullest extent permitted by law, HOGA, its owners, instructors, and staff are not liable for:

  • Injuries sustained during training
  • Loss or damage to personal property
  • Any consequential or indirect damages

4. Membership Policies

4.1 Freezing Memberships

  • Memberships may be frozen once per year
  • Freezing requires advance notice and may require documentation
  • Medical freezes may be granted with appropriate documentation
  • Frozen memberships maintain their original expiration terms

4.2 Cancellation Policy

  • Memberships can be cancelled at any time without advance notice
  • Cancellations take effect at the end of the current billing period
  • All membership types are non-refundable and non-transferable

4.3 Refund Policy

  • No refunds are provided for any membership type or service
  • All payments are final and non-refundable
  • This policy applies regardless of usage, circumstances, or reason for cancellation

5. Behavioral Standards

5.1 Respect and Inclusion

HOGA is committed to providing a welcoming environment for all members regardless of:

  • Race, ethnicity, or nationality
  • Gender identity or sexual orientation
  • Religious beliefs
  • Physical ability
  • Experience level

5.2 Zero Tolerance Policy

We maintain a zero-tolerance policy for:

  • Discrimination or harassment of any kind
  • Sexual misconduct or inappropriate behavior
  • Violence or threats outside of supervised training
  • Bullying or intimidation

5.3 Disciplinary Actions

Violations may result in:

  • Verbal or written warnings
  • Temporary suspension
  • Permanent termination of membership without refund
  • Legal action when appropriate

6. Intellectual Property

6.1 Training Content

  • All training methods, curricula, and techniques remain our intellectual property
  • Recording or reproducing our content without permission is prohibited
  • Members may not teach our proprietary methods without authorization

6.2 Media Rights

By training at HOGA, you consent to:

  • Photography and videography for promotional purposes
  • Use of your likeness in marketing materials
  • Social media posting featuring your participation (unless you opt out)

7. Privacy and Data Protection

7.1 Personal Information

We collect and process personal information in accordance with Swiss data protection laws, including:

  • Contact information
  • Health and fitness data
  • Payment information
  • Training progress records

7.2 Data Security

We implement appropriate security measures to protect your personal information and will not share it with third parties except as required by law or for essential business operations.

8. General Provisions

8.1 Modification of Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated with 30 days' notice. Continued use of our services constitutes acceptance of modified Terms.

8.2 Governing Law

These Terms are governed by Swiss law and any disputes will be resolved in the courts of Zurich, Switzerland.

8.3 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

8.4 Entire Agreement

These Terms, along with our gym rules and any membership agreement, constitute the entire agreement between you and HOGA.
